Distance sales contract
A sales contract concluded through remote means such as the internet, without the seller and consumer meeting physically; in Turkey it is governed by the Distance Contracts Regulation.
- 01
Why it matters
Every business selling online must present the contract and the pre-contractual information to the consumer and obtain their approval. With certain exceptions, the consumer has the right to withdraw within 14 days without giving a reason. An incomplete or wrong contract increases the risk of complaints and administrative fines.
- 02
Example
At a shop's checkout, the pre-contractual information form and the distance sales contract are shown with the order summary; the customer cannot pay without approving them, and a copy of the contract is sent by e-mail.
- 03
Common mistake
Copying contract text from another site. A text that does not fit the product type, withdrawal exceptions, shipping and return terms can be interpreted against the business in a dispute.
