Pre-contractual information form

In distance sales, the form that informs the consumer before the contract is concluded of the seller's identity, the product's main features, the total price, delivery and withdrawal terms.

  1. 01

    Why it matters

It is a legal requirement that consumers see clearly, before buying, what they are buying, from whom, for how much and on what terms. The form must be approved before the order is paid. Stating the total price clearly, including taxes and shipping, prevents a large share of later disputes.

  2. 02

    Example

A site selling a subscription box states clearly in its pre-contractual form the subscription period, the renewal terms and how to cancel; the customer moves to payment only after seeing and approving it.

  3. 03

    Common mistake

Sending the form only by e-mail after the order. As the name says, pre-contractual information must be given and approved before the contract.
