We're a small workshop in Berlin producing natural soaps and skincare products. honestly over the past two months, to boost brand awareness, we sent gift boxes worth a total of 1,200 Euro to 15 local micro-influencers across Germany. We didn't sign written contracts with anyone; we just slipped a friendly note inside mentioning we were sending our products for them to try and that they were welcome to mention them on their accounts if they liked them.

11 of the recipients posted stories and feed posts but 4 of them didn't use any "Werbung" or "Anzeige" tags whatsoever. I mean the other day, an industry colleague told me this could be treated as a direct violation of unfair competition law in Germany and that we could get hit with costly cease-and-desist warnings from competitors' lawyers.

When and where exactly does an ad label become mandatory for free gifts? tbh if the influencer skips the tag does the legal fine fall directly on our company and what should we do at this point?

Short answer: In Germany, when a business sends products with a commercial intent—even free of charge—any social media post featuring them is legally considered advertising and must clearly include an ad disclosure. If the creator fails to label it, under unfair competition law, both the poster and the brand owning the products bear direct legal liability.

Under the German Unfair Competition Act (UWG) and the Digital Services Act, if a promotion has commercial intent or any material benefit behind it—even a gift—consumers must be able to tell at first glance. Even if the 1,200 Euro worth of products were sent as free gifts, the implicit encouragement to post makes it a commercial communication.

In an audit or if a competitor's lawyer spots it, the legal warning process called an Abmahnung kicks off. These letters usually demand reimbursement for legal fees ranging from 1,000 to 2,500 Euro alongside a signed cease-and-desist declaration with penalty clauses.

Steps you should take immediately: 1) Reach out in writing right away to those 4 creators and ask them to add the ad disclosure right at the beginning of their posts, or take them down. 2) Keep a timestamped archive of your communications and warning messages. 3) For any future gift packages, always include a brief note explaining the legal disclosure requirement.

You don't mess around with this in the German market. There are law firms and competition associations whose sole business model is scraping the web for missing disclosures and sending out warning letters to make money. Claiming "it was just a gift" won't fly. The moment that letter lands, you're on the hook for costs, so get those posts fixed today.

Contact those 4 people immediately. Ask them to turn on Instagram's paid partnership tool, or visibly add the German ad disclosure to the very first line of the caption. If it was a story and 24 hours have already passed, it's gone anyway, but if it's pinned in highlights or on the feed, take action without wasting any time.

According to recent precedent set by the Federal Court of Justice, the placement of the disclosure is also critical. Hiding the tag at the bottom of the caption, behind the "more" button, or cramming it among dozens of hashtags is also considered a violation. The word must be clearly visible, in capital letters, right at the beginning of the text.

We ran into a similar mistake two years ago. No tag was included for a bag we sent worth 45 Euro. We received a cease-and-desist letter from a competitor's lawyer with an invoice totaling 1,480 Euro in legal fees. Ever since, we don't ship anything out—even free products—without getting a signed one-page agreement first.

Do you have a copy of the note you included in the package? The tone of the wording can serve as evidence in a potential dispute regarding whether "feel free to share if you like it" is deemed an implicit promotional agreement by the authorities or a completely unconditional gift.

Don't panic for now; as long as you haven't received a warning letter yet, you're in luck. Explain the situation honestly to the creators without straining your rapport with them. If you explain the legal requirements in Germany, most of them will be understanding and update the captions within minutes.

Everyone immediately jumped to legal fees, but the odds of fair-trade associations catching minor posts from 4 out of 15 micro-accounts the very next day are like winning the lottery. Of course it should be fixed, but it's nothing to lose sleep over.
