We bought custom software — over how many years should we depreciate it (Germany)?

We run a bonded warehousing and partial-load logistics company in Stuttgart. Because off-the-shelf logistics suites didn't fit our dispatch and customs workflows we had a local software house build custom operations software for our business. anyway under the contract, we paid the development firm a total of 45,000 Euro and acquired the source code along with all usage rights.

The software was fully delivered last month and is now actively used in our daily operations... When I brought this up with our tax advisor (Steuerberater), he was rather vague, saying that standard software and bespoke company-specific software might be treated differently on standard depreciation tables.

Under German rules, over what useful life is an investment in this type of custom software depreciated on the balance sheet? I heard there was some regulatory easing recently regarding digital assets. tbh do we have the option to write this entire amount off immediately as an expense or do we have to spread it over several years?

Short answer: Under German tax law, custom software is generally considered an intangible asset and, according to standard official depreciation tables, is written down over a useful life of three to five years. However, thanks to the updated ruling issued by the Federal Ministry of Finance regarding digital assets, operating and application software can now be assigned a useful life of one year, allowing the full investment to be written off in the financial year of acquisition.

How this applies to your balance sheet depends on two key points: 1) Acquisition and ownership structure: Since this software was commissioned from an external software vendor and the IP rights were transferred to you, it is classified as an externally acquired intangible asset rather than an internally generated one. Capitalization is therefore mandatory. 2) The one-year useful life rule: Under the Ministry of Finance circular, you can opt for a one-year useful life for ERP, logistics, and data management software instead of the standard multi-year period. This effectively gives you the advantage of expensing the 45,000 Euro invoice immediately.

When talking to your Steuerberater, confirm the delivery and invoice dates, as well as the fact that the software contains proprietary business logic. If you want to reduce this year's profit and minimize your tax base right away, you can opt for the one-year useful life; however, if your priority is maintaining a strong balance sheet for bank credit ratings, you are completely free to stick with the traditional three-year schedule.

It's understandable that your accountant hesitated, because historically they used to separate bespoke software from standard software and stretch it out up to five years. But current tax practices allow an immediate write-off for operational business tools like logistics software, which is a massive cash flow relief for businesses.

At the end of 2022, we commissioned custom barcode and inventory software for our warehouse for 38,000 Euro. Our Steuerberater applied the one-year useful life based on the recent circular, and we deducted it straight from that year's profits. It saved us roughly 11,000 Euro in corporate income tax.

Before making a call, run the numbers for both scenarios: 1) If you're showing high profits this year, choose the one-year depreciation and deduct the entire 45,000 Euro from your taxable base. 2) If you're planning to apply for bank loans in the coming years for major fleet or warehouse investments, stick to the three-year depreciation so you don't dilute your balance sheet.

Before jumping to write it off in a single year, take a close look at the terms of your software contract. If the invoice bundles the software development costs together with annual maintenance or licensing fees, the tax office might demand that you break down the invoice during an audit.

Have the software house split the invoice into two line items: keep the 45.000 Euro clearly labeled as development and IP transfer, and if there's a support contract for the following months, book that as a monthly expense via a separate invoice. Your bookkeeping will be much cleaner that way.

remind your cpa about the bmf circular sometimes they get stuck on the old rules and say three years but it can be fully written off in the same year now we had the exact same thing happen they fixed it once we reminded them.
