What is the full checklist of requirements to set up an e-commerce site, and which documents are mandatory?

Up until now, we've only taken orders through social media for our boutique ceramic studio. tbh we sell an average of 40-50 pieces a month and keeping track of orders via DMs has become operationally impossible. We want to launch our own standalone website and switch to a proper e-commerce setup where we can accept credit card payments directly. We've set aside a starting budget of around 45,000 TL for this transition.

However, rather than the software side we're really confused about the legal requirements and paperwork process. anyway what's the proper order of steps for setting up a sole proprietorship, applying for a virtual POS ETBİS registration, and mandatory site policies like the distance sales contract? Which missing documents would bring the process to a halt, and how much will we be spending out of pocket on notary and official fees early on?

Short answer: To legally sell through an e-commerce website you first need a registered company with tax liability distance sales and privacy policies on your site followed by a virtual POS application and ETBİS registration. Even if your technical infrastructure is ready, you cannot start taking payments without a vergi levhası and approved legal texts.

First off, you need to hire a certified public accountant and set up a sole proprietorship. Setting up a sole proprietorship through the interactive tax office usually takes 1-2 business days, and startup costs run between about 1,500 TL and 2,500 TL, including the notarized signature declaration. Once the company is formed you can apply to banks or licensed payment institutions for a virtual POS using your tax plate, signature declaration, and corporate bank account details.

The second stage is the legal framework of the website. Under the Law on the Protection of the Consumer, your site must feature a Preliminary Information Form, Distance Sales Contract, Cancellation and Return Policy Privacy Policy, and a KVKK disclosure text. Virtual POS providers will not approve your application unless these texts are live on the site and included as consent checkboxes during checkout.

Finally, you are legally required to register on the Ministry of Commerce's Electronic Commerce Information System ETBİS within 30 days from the date you start selling. This registration is done free of charge via e-Devlet; you simply need to provide your server location, payment methods and shipping carrier agreement details.

The moment you form the company your very first task should be securing a corporate shipping agreement. Virtual POS providers sometimes stall the approval process without a carrier contract because they want proof that you're actually shipping physical products. The day your sole proprietorship's vergi levhası is issued, talk to at least two shipping companies and open a corporate billing account.

When it comes to the legal policies, don't just copy and paste random templates off the internet. Since you're selling ceramics, the risk of transit breakage is high. Make sure your lawyer clearly drafts the clauses covering defective goods delivery and official damage assessment reports (hasar tespit tutanağı) in the distance sales contract; otherwise, consumer arbitration boards will consistently rule against you.

For the sole proprietorship I set up last month, my net expenses were as follows: Notary signature declaration 740 TL, accountant incorporation power of attorney 2,200 TL; we opened it purely through the tax office field check without registering with the chamber of commerce. Virtual POS providers didn't charge an annual fixed fee, but they take a commission of around 2.9 to 3.5 percent on average per successful transaction.

For 40-50 items a month, have you considered an open-source platform instead of tying up 20-30k TL a year in turnkey e-commerce software packages? How much of your starting budget did you allocate to software versus company formation and inventory?

definitely don't put off the etbis registration guys, people end up forgetting about it later. once the site is up you can sort it out yourself via e-devlet in 15 mins anyway and it doesn't cost anything get it done within the first month so you don't get fined.

Integrating a virtual POS doesn't always go as fast as people think. If the site is missing a contact page, lacks an SSL certificate, or doesn't show the return policy checkbox in the checkout flow, you get an outright rejection during review, setting your application back ten days. Don't apply until every single page on the site is fully populated.

We also got fed up with taking orders through DMs and switched to a website. Believe me once invoicing and inventory tracking are automated, a massive weight is lifted off your shoulders. Dont let the paperwork intimidate you at first, it all gets sorted out within a week.
